Fovon Terms of Service
Welcome to Fovon!
These Terms of Service (the “Terms”) govern your use of our video platform — a service that lets users find, watch, share and browse popular creator-uploaded videos for free — and they form a legally binding contract between you and Fovon. Any access to, or use of, our platform Services means that you accept every provision of these Terms and agree to be bound by them. If you do not agree to any part of the Terms, you must not use our platform Services.
Important Notice
Section 18 of this agreement contains a binding arbitration clause. Subject to a limited set of exceptions, such as intellectual property infringement claims, all disputes between you and Fovon will be resolved through binding arbitration, and both parties waive any right to commence or participate in class actions.
1. Eligibility Requirements
- Minimum Age: Registration and use of Fovon’s full platform Services require that you are at least eighteen years of age. Features that are introduced later as premium options may carry a higher age requirement, which will be indicated when you first use the feature.
- Legal Capacity: Your use of Fovon’s services confirms that you have the legal capacity to make a binding agreement, to comply with the terms of this document, and to observe all applicable local, national and international laws.
- Entity Use Authorization: If you use Fovon for a business or a government organization, you confirm that you are duly authorized to bind that organization to all terms of these Terms.
- Minor Access Prohibition: Persons below eighteen years of age are barred from registering accounts and from using Fovon’s platform Services. We may permanently close accounts that we reasonably believe belong to underage users, without prior notice.
2. User License
- Personal Use License: Fovon grants you a personal, worldwide, royalty-free, non-transferable license to access and use all platform Services — including finding trending user-submitted videos, streaming, sharing and browsing content — for their intended purposes. This license continues only while you fully comply with all provisions of these Terms.
- Automatic Updates: Software updates, such as fixes for video playback problems and newly added features, may be downloaded and installed automatically as part of our platform Services. You may disable automatic updates in the system settings of your mobile device.
- License Restrictions: Fovon’s proprietary software and services may not be copied, modified, sold, reverse engineered or sublicensed unless Fovon’s management team has given prior written approval.
3. Content License to Fovon
- Ownership of Your Content: When you create, upload or share media — including videos, public comments, photos and captions, together referred to as “Your Content” — you continue to own all Your Content in full. You additionally grant Fovon a worldwide, royalty-free, sublicensable license to host, store, display, stream, format adjust (for example, optimizing video resolution for different device screen sizes) and distribute Your Content. The license exists solely to support the operation, maintenance and improvement of our video platform, including making your uploaded videos available to other users.
- License for Public Content: Media that you publish in public parts of the platform, such as trending video feeds and public comment sections, is covered by a perpetual, worldwide, royalty-free, sublicensable license granted to Fovon to publicly broadcast, display, reproduce and create derivative works. Your uploaded video may, for example, be included in a curated “Top Viral Videos” compilation. Under this license, your full name and profile image may be shown with your published content, and no further compensation is payable to you.
- Content Moderation Rights: Fovon may review, remove or modify any of Your Content at any time, for example by deleting videos that violate these Terms. We are, however, under no legal obligation to actively monitor all user-generated content on the platform, and you are solely responsible for all of Your Content that you post on Fovon.
- Advertising Consent: As a condition of free access to video browsing and content sharing features, you agree that commercial advertisements may be displayed across all platform Services.
4. Your Responsibility for Uploaded Content
- Full Liability for Content: You bear full legal responsibility for all of Your Content published on Fovon. Your uploads must not infringe third-party rights — including the copyright in background music used in your videos and trademark rights — and must not violate applicable local or national laws, such as laws against defamation or obscenity.
- Prohibited Content: Content that is illegal, harmful, discriminatory (based on race, gender, religion or other protected characteristics), graphically violent, sexually explicit, or that promotes harassment, exploitation or criminal activity may not be uploaded or shared. This includes child sexual abuse material (CSAM), hate speech and footage of illegal acts.
- Reporting Violations: Illegal or inappropriate content, such as violent videos, may be reported through our built-in reporting tool or by emailing our official service inbox: [email protected]. Once a breach is confirmed, our team may remove the content and suspend or terminate the responsible accounts.
5. Privacy of Your Data
Protecting your personal privacy is a top priority for our team. Our official Privacy Statement, accessible within the Fovon mobile application, describes in detail how we collect, use and share your personal data in connection with our video platform Services. By using any Fovon service, you consent to all data practices described in that Privacy Statement.
6. Prohibited Conduct
The following acts are prohibited while using Fovon’s Services:
- Harassing, threatening, intimidating or impersonating other users is not tolerated. This includes, by way of illustration, posting abusive comments on other creators’ videos and pretending to be another person.
- Tampering with the platform’s security systems, bypassing access controls, or using automated tools such as bots to scrape video data, artificially inflate video view counts or disrupt normal platform operation.
- Dissemination of malicious software, spam messages or unlawful material — child sexual abuse material (CSAM) included — across any part of the platform Services is forbidden.
- Commercial use of Fovon’s features, such as selling physical goods through video comments or advertising external services, requires prior written approval from the management team.
- Encroachment on third-party intellectual property rights — whether through videos that make unauthorised use of copyrighted music or through evasion of the platform’s digital rights management (DRM) mechanisms — is not allowed.
- Participating in money laundering, fraud or exploitation of vulnerable people. All activity involving child sexual abuse material (CSAM) is subject to our strict zero-tolerance policy.
Zero-Tolerance Child Safety Policy
Fovon applies an absolute zero-tolerance policy to child sexual abuse material (CSAM) on our platform. Suspected prohibited material should be reported immediately. Our team will remove all related content, suspend or permanently ban the responsible account, and cooperate fully with law enforcement during any investigation.
7. Copyright Policy
Fovon honours the intellectual property rights of creators and rights holders. A good faith belief that content on Fovon, such as a user-uploaded video, infringes a copyright should be communicated through a written infringement notice sent to [email protected] and containing all of the following elements:
- Your physical or electronic signature.
- A full account of the copyrighted work that is claimed to have been infringed.
- The precise location of the infringing content, whether full video URLs or instructions sufficient to find it within the app.
- The complainant’s full contact details: name, mailing address, phone number and email address.
- A declaration, given under penalty of perjury, of a good faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.
Accounts of registered users repeatedly found to have committed verified copyright infringement may be permanently terminated.
8. Account Rules
- Account Security: You are responsible for keeping your account login credentials secure, including keeping your password confidential. Sharing your login information, or accessing your Fovon account through unauthorized third-party software, is prohibited.
- Account Usage Rules: Unless explicitly permitted by official platform guidelines, you may not register multiple duplicate accounts, sell or transfer your account, or reactivate accounts that were disabled for policy violations.
- Reporting Unauthorized Access: Signs of unauthorised access — such as videos appearing on the account without the user’s own action — should be reported to the support team without delay at [email protected].
9. Content Moderation
- Automated and Human Review: Two review systems are used by Fovon: automated content detection software configured to identify violent or sexually explicit video content, and trained human moderators who inspect all published content for violations. It must be noted that detection of every type of prohibited content uploaded by users cannot be guaranteed to be 100% accurate.
- User Reporting: The built-in reporting tool lets users flag inappropriate content, including harmful videos and spam comments. The moderation team targets completion of all reported violation reviews within 24 hours, and may remove violating content or impose temporary or permanent account suspensions once a policy breach is confirmed.
10. In-App Purchases and Payments
In the event that Fovon later introduces optional premium features or virtual products — such as ad-free video streaming or access to exclusive locked trending content:
- Transparent Pricing: All prices are shown clearly before any purchase is completed. Payment processing is handled by authorized third-party payment providers such as the Apple App Store and Google Play Store.
- No Refund Policy: Except where required by applicable consumer protection laws such as EU consumer regulations, all completed purchases are final and non-refundable. Subscriptions renew automatically unless you cancel through your app store account at least twenty-four hours before the next billing date. Cancelling does not entitle you to a refund for any unused portion of the current subscription period.
- EU Consumer Rights: Users residing in the European Union may request a full refund for subscription purchases within fourteen calendar days of purchase, provided that they have not accessed or used any premium features during that period.
11. Mobile Data Charges
All mobile data charges, text messaging fees and other telecommunications costs incurred while using Fovon’s Services — for example, streaming or uploading videos over a cellular network — are your responsibility. Contact your mobile service provider for details about data rates and billing.
12. Anti-Slavery and Anti-Human Trafficking Policy
Slavery, human trafficking and exploitation of vulnerable people are prohibited by Fovon in all forms. Suspected violations should be reported to the official email address [email protected]. A full investigation is conducted by the management team, all violating content is removed, and complete cooperation is extended to the relevant law enforcement authorities.
13. Anti-Fraud and Compliance
- Scam Prevention: Money, financial information such as credit card details, or participation in suspicious financial transactions with other platform users must be avoided. Confirmed scams, such as users requesting payment through video comments, should be reported to the service inbox at [email protected].
- Anti-Money Laundering (AML) Compliance: To meet mandatory anti-money laundering legal requirements, Fovon may request government-issued identity documents. Refusing or failing to provide the requested identification may result in temporary suspension of your account access.
14. Service Changes and Account Termination
- Service Modification Rights: Fovon may launch new features such as in-app video editing tools, remove existing features, suspend service temporarily, or discontinue all Fovon services at any time, with or without prior notice. Reasonable steps will be taken to notify registered users of major changes to core services, such as permanent removal of the core video-sharing function.
- Account Suspension and Termination: For confirmed violations of these Terms, prolonged account inactivity, or harmful user conduct, our management team may suspend or permanently terminate your account and revoke all access to our Services, with or without prior written notice. After termination, you lose all access to platform features, including your uploaded videos and purchased premium services.
15. Indemnification
Users undertake to indemnify, defend and hold harmless Fovon, its affiliated companies, directors, employees and authorised third-party agents against all claims, damages, liabilities, costs and legal fees (attorney fees in full included) that arise from the user’s use of Fovon’s Services, any Your Content posted on the platform (copyright infringement lawsuits resulting from uploaded videos, for example), or any breach of these Terms that is confirmed against the user.
16. Disclaimers
- As-Is Service: Fovon Services are supplied on an “as is” and “as available” basis, without express or implied warranties of any kind. Interrupted service, imperfect video playback and incomplete accuracy or safety of user-generated content on the platform are all possibilities that Fovon does not warrant against.
- No Liability for User-Generated Content: Fovon is not legally liable for offensive, illegal or misleading content posted by other users, including harmful videos and false comments. All user-generated content accessed on the platform is done so at the user’s own risk.
17. Limitation of Liability
Fovon and its partner entities bear no liability for indirect, consequential or punitive damages of any kind. The total maximum aggregate liability for all claims is the greater of one hundred United States Dollars (USD 100) or the total amount paid to Fovon in the twelve consecutive calendar months preceding the claim.
18. Binding Arbitration
- Dispute Resolution: Binding arbitration, rather than court litigation, is the required forum for most disputes between users and Fovon. A mutually agreed arbitration forum such as USIETAC administers the arbitration under its official procedural rules.
- Class Action Waiver: Individual arbitration is the exclusive route for every dispute; consolidated or class action lawsuits find no place under this agreement.
- Opt-Out Right: You may opt out of the binding arbitration clause within thirty calendar days of first using the platform Services. To opt out, send a written notice to Fovon’s management team by email at [email protected] or to the physical address listed in the Fovon mobile app, including your full name, registered account email address and a clear statement that you are opting out.
19. Intellectual Property Statement
All video content uploaded by registered users to the Fovon platform must be original works independently created by the uploading user, who must hold full intellectual property ownership rights — including, but not limited to, copyright, trademark, patent and trade secret rights — to the uploaded content. Registered users may not upload or publish content that infringes third-party intellectual property rights, including unauthorised copying, adaptation, editing or clipping of externally owned video, audio, text or image files. Once confirmed infringing content is identified by the moderation team, Fovon holds the immediate right to delete the violating material permanently and reserves the right to pursue full legal liability against the responsible user. If Fovon suffers measurable financial losses as a direct result of the infringing conduct, the responsible user must fully compensate Fovon for all such losses.
20. Governing Law
The civil laws of the State of Delaware, excluding its conflict of law principles, govern these Terms exclusively.
21. Severability
If a court of competent jurisdiction finds any provision of these Terms unenforceable, that provision is severed from the agreement and all remaining provisions stay in full legal force and effect.
22. Supplementary Terms
Certain platform features, such as official creator monetization programs, may have separate supplementary terms. These terms are shown when you first access the relevant feature and become legally binding parts of this agreement once accepted.
23. General Terms
- Entire Agreement: This Terms of Service document, in combination with the Privacy Statement and any supplementary feature terms, amounts to the whole agreement between users and Fovon and displaces every earlier oral or written arrangement.
- No Third-Party Beneficiaries: No enforceable rights are granted to any third party, including other Fovon users, under this agreement.
- Non-Waiver: If Fovon’s management team does not enforce a particular provision of these Terms on one occasion, our right to enforce that provision in future cases of verified policy violation is not waived.
- Assignment: Your rights under these Terms may not be assigned or transferred without prior written approval from Fovon’s management team. Fovon may assign and transfer its rights and obligations under this agreement freely, at its sole discretion.
- English Language Priority: In case of conflict between translated versions of these Terms and the original English version, the original English version is the sole legally authoritative version.
